The Machinery Regulation (EU) 2023/1230 replaces the previous Machinery Directive (2006/42/EC) and introduces key updates to ensure the safety, performance, and efficiency of machinery products in the European single market. The Regulation was published in the Official Journal of the EU on 29 June 2023 and came into force on 19 July 2023, replacing the Machinery Directive 2006/42/EC. There is a transitional period, and Manufacturers must comply as of 20 January 2027. Manufacturers of industrial machinery, including grinding machines, lathe machines, and packaging equipment, must now comply with this updated regulation to ensure seamless market access. The Regulation aims to enhance the safety of machinery and facilitates its circulation within the EU market, while incorporating more stringent safety standards for emerging technologies like AI-powered systems and cyber security.

What’s new with the Machinery Regulation (EU) 2023/1230?
- Increased focus on cyber security and AI-powered machinery: Enhanced safety requirements for digitally connected and intelligent systems are now a central part of the regulation.
- Digital operating instructions: Manufacturers can now provide digital user manuals, which increases flexibility and supports a more sustainable approach to documentation.
- More detailed risk assessments: New categories of risk and a more detailed risk assessment process are introduced to better evaluate and mitigate hazards.
- Updated market surveillance: The regulation strengthens market surveillance and updates conformity assessment procedures, ensuring only safe and compliant machinery enters the market.
- Clarified risk coverage: The new Machinery Regulation explicitly addresses emerging risks such as artificial intelligence and cybersecurity. While this does not significantly broaden the scope of products compared to Directive 2006/42/EC, it does expand the risk considerations for machinery already within the regulation’s scope.
- Substantial modifications: The regulation addresses modified machines, which require a new conformity assessment.
