Manufacturers need to ensure they are meeting global regulatory requirements surrounding biodegradability claims.

Today’s consumer are knowledgeable and wary of misleading sustainability marketing claims or “eco-claims” that are reported on products and packaging, sometimes referred to as greenwashing. Regulatory bodies around the world have established extensive guidelines to prevent deceptive labelling.

Intertek’s Biodegradable in Anaerobic Environments Conformity Program supports suppliers and manufacturers in certifying and communicating biodegradability claims of their materials, products and/or packaging, in accordance with global labelling standards.

Certification

Intertek’s Biodegradability Program includes an evaluation report, certificate, and the use of an Intertek Sustainability Certification mark that can be applied on products and packaging to help you to effectively market your biodegradability claim to your customers.

Benefits

There are several benefits to certifying your biodegradability claims, such as:

  • Ensuring compliance with global regulatory requirements for environmental labelling and “eco-claims”,
  • Satisfying procurement requirements and customer expectations for sustainable products,
  • Meeting consumer demands for greater transparency,
  • Differentiating your product with certification from an independent third party.

Process

The verification process involves several steps with the Intertek team including:

  1. Data Collections and Analysis: Intertek helps you assemble your data and documentation required for our review. This includes information about the product description, material composition, and completed testing reports from independent laboratories that are accredited according to ISO 17025 or similar. This will determine if conformance is achieved as well as the nature of your claim.
  2. Evaluation: The Intertek evaluator writes a draft assessment report that details the findings of the review, including data analysis from completed laboratory reports, non-conformities, and opportunities for improvement.
  3. Technical Review: The Intertek Program Manager reviews the evaluation and report, which is then sent to you for review and comment, prior to certification.
  4. Certification Decision: If the requirements of the verification are met, Intertek issues the final report, certificate(s), and certification mark. Once certified, your company and products are listed on the Intertek Sustainability Certification Directory
  5. Certification Maintenance: Certification is valid for 3 years provided there are no changes to materials, suppliers, processes, etc. Intertek’s Certification Manager will send a brief survey each year to confirm that no changes have occurred.

    Frequently Asked Questions

The required biodegradation test is ASTM D5511 – 18, or equivalent.

The product has to be compliant with the EU Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) regulation (EC) No 1907/2006. Substances of very high concern (SVHCs) not complaint with REACH will not be certified. The presence of hazardous substances must be disclosed, e.g. heavy metals. If present, the product has to be tested to ensure the heavy metal concentrations are within the acceptable limits.  No disintegration or ecotoxicity requirements have to be met. Nevertheless, materials or products containing constituents or components that include an evident risk of visual contamination are not accepted.

The certification is valid for three years; however, the certificates are issued with an annual expiry and are renewed after the certification team has confirmed that there has been no change to the product. The client will receive 1 certificate annually for the next 3 years. The renewal cost is embedded in the certification for 3 years.

The program is compliant in accordance with ISO 14021: 2016 Environmental labels and declarations – Self-declared environmental claims (Type II environmental labelling), United States Federal Trade Commission (FTC) 16 CFR Part 260 Guides for the Use of Environmental Marketing Claims (2012) and EN 13432: 2000 Packaging - Requirements for packaging recoverable through composting and biodegradation - Test scheme and evaluation criteria for the final acceptance of packaging.
