Intertek Offers Solutions to Germany's Cease and Desist of Sales Orders for WEEE Non-Compliance

In 2007, the Appellate Court of Düsseldorf made a ruling that confirmed that the issuing of cease and desist orders will be upheld in regards to WEEE. Specifically, compliant producers of WEEE may sue non-compliant competitor producers of WEEE if they are not fulfilling their WEEE requirements (registration, marking, treatment documentation, and take-back) in Germany. Note that this action by a compliant producer against a non-compliant producer is a separate action from the enforcement activities of the German authorities themselves. A non-compliant producer could still receive enforcement actions from the German authorities, such as imposed fines, in addition to any penalties assigned through the violation of competition law.
