The Safe Drinking Water and Toxic Enforcement Act, commonly known as Proposition 65 (or Prop 65), has been in effect in California since 1986. It requires marketers to report the presence of chemicals known to be hazardous in consumer goods by a specific labelling.

This legislation is intended to protect California citizens and drinking water sources from chemicals known to cause cancer, birth defects or other reproductive harm. It informs Californians about exposures to these substances in consumer products distributed on the local market including cosmetic products.

The producer therefore has the obligation to inform consumers of the presence of carcinogenic or toxic substances in their product by affixing a label: "Warning label".
