The U.S. Consumer Product Safety Commission (CPSC) has published a direct final rule to approve the new 16 CFR 1272 Marking of Toy, Look-Alike and Imitation Firearms.

This new CFR applies to toy, look-alike, and imitation firearms that have the appearance, shape, and/or configuration of a firearm and have been produced or manufactured and entered into commerce on or after May 5, 1989. However, the following products are not subject to this regulation:

  • Non-firing collector replica antique firearms
  • Traditional B-B, paintball, or pellet-firing air guns
  • Decorative, ornamental, and miniature objects that have the appearance, shape and/or configuration of a firearm

Products covered by this regulation must meet one of the following marking requirements:

  1. Affix a blaze orange (or brighter) solid plug permanently to the muzzle end of the barrel as an integral part of the entire device and recessed no more than 6 mm from the muzzle end of the barrel
  2. Affix a blaze orange (or brighter) marking permanently to the exterior surface of the barrel, covering the circumference of the barrel from the muzzle end for a depth of at least 6 mm
  3. The product is entirely transparent or translucent materials which permits unmistakable observation of the product’s complete contents
  4. The entire exterior surface of the product shall be in white, bright red, bright orange, bright yellow, bright green, bright blue, bright pink, or bright purple, either singly or as the predominant colour in combination with other colours in any pattern.

The new CFR will become effective on June 26, 2023.
