On June 10th, the Consumer Product Safety Commission (CPSC) issued notice announcing Beta pilot for electronic filing (e-filing) of certain data elements of the Certificate of compliance (CPC/GCC) for the regulated consumer products, along with requesting applications for participation in this pilot.

Beta pilot is building on the Alpha pilot CPSC staff conducted in 2016. Similar to the Alpha pilot, electronic filing may be done with the Customs and Border Protection (CBP) via the partner government agency (PGA) message set to the Automated Commercial Environment (ACE) system, or E-file in CPSC Registry and use that unique identifier for filing with CBP entry.

CPSC is seeking up to 50 importers to participate in this pilot. Of the 50 importers, a subset of up to 9 participants will be selected to advise CPSC during the technology development (IT) phase of the project.

CPSC plans to include approximately 300 HTS codes including, but not limited to: ATVs; durable products, such as baby carriages, cribs, and safety gates; children’s furniture, backpacks, and school supplies; bicycle helmets; bicycles and other electric-powered cycles; clothing (sleepwear, outerwear, infant articles, potentially flammable adult clothing articles); drywall; fireworks; children’s jewelry; lighters; liquid nicotine; mattresses; pacifiers and rattles; rugs; and toys.

Timeline for Beta pilot:

  1. Duration: at least 6 months
  2. Projected start date for discussion: Fall 2022
  3. Anticipated start date for e-filing: October 2023

Data elements that will be required for e-filing:

  1. Identification of the finished product (may use reference to GTIN 8 data for this element);
  2. Each consumer product safety rule to which the finished product has been certified;
  3. Date when the finished product was manufactured;
  4. Place where the finished product was manufactured, produced, or assembled, including the identity and address of the manufacturing party;
  5. Date when the finished product was most recently tested for compliance with the consumer product safety rule cited above;
  6. Parties on whose testing a certificate depends (meaning the name and contact information for the entity that conducted the testing); and
  7. A check box indicating that a required certificate currently exists for the finished product, as required by Sections 14 and 17 of the CPSA.

Deadline to submit participation requests to the CPSC is July 25, 2022. CPSC may close the deadline earlier if they receive 50 applicants.
