Before marketing a new chemical in the Americas and in order to meet the various national and international legal requirements, the manufacturer/importer has to submit information in the form of a notification or registration (e.g. phys-chem, toxicological, ecotoxicological data) to support each Government’s risk assessment scheme to determine whether the substance poses an unreasonable risk to the environment and/or human health.

This webinar series is meant to give you practical information on the chemical notification process in the Americas starting in Canada and travelling down through the United States to Argentina. During these webinars, we will also expand on initiatives, policy changes and on Government initiative for chemicals.

Throughout all of these data submission and assessment activities it is critical that companies request and substantiate claims to protect their confidential business Information (CBI). Canada's New Substances Fundamentals

USA's TSCA Fundamentals

The primary federal industrial chemicals management law in the United States (U.S.) is the Toxic Substances Control Act (TSCA) as amended by the 2016 Frank R. Lautenberg Chemical Safety for the 21st Century Act (LCSA). The main objectives of the Act are to assess and regulate new commercial chemicals before they enter the market and to regulate existing chemicals that pose an "unreasonable risk to health or to the environment". When chemicals are found to pose an unreasonable risk, the EPA will regulate the distribution and use of those chemicals. 

This session will provide an overview of the regulation including listing the chemical substance on the inventory, key information to determine if an exemption can be uses, other notices that are required for TSCA compliance and general information on how to be compliant with the TSCA in the U.S.

USA's PMN Completion and Filings

In the session, the details of developing a Pre-Manufacture Notice (PMN) dossier as prescribed in the Toxic Substances Control Act (TSCA) is discussed. In addition to chemical identity and hazards, the submitter must supply details on how the substance is manufacture, or details of importation, uses, any exposure anticipated in the environment and to people, etc. We will also review common errors the EPA finds and how to avoid them.
