Phthalates, which have been linked to numerous health risks, have been found in children’s toys, plastic bath books, teething rings, and many other plastic products intended for use by children.
The California Toxic Toys bill (Assembly Bill 1108) bans the manufacture, sale, or distribution in commerce of certain toys and child care articles that contain di-(2-ethylhexyl) phthalate (DEHP), dibutyl phthalate (DBP), or benzyl butyl phthalate (BBP), in concentrations exceeding 0.1%.
AB 1108 also prohibits the use of phthalates in the manufacture, sale, or distribution in commerce of certain toy or child care articles intended for use by a child under three years of age if the product can be placed in the child's mouth and it contains diisononyl phthalate (DINP), diisodecyl phthalate (DIDP), or di-n-octyl phthalate (DnOP), in concentrations exceeding 0.1%, beginning January 1, 2009.
The California Toxic Toys bill also requires manufacturers to use the least toxic alternative available when replacing phthalates in their products and prohibits manufacturers from replacing phthalates with certain carcinogens and reproductive toxicants.
