Taiwan Existing Chemical Substance Nomination (ECN) Services

The Taiwan Existing Chemical Substance Nomination (ECN) Directions 2009/11/02 of the Council of Labor Affairs (CLA) had originally required submission of a “Chemical Substance Nomination” to the Authorities by a December 31, 2010 deadline, in order for a chemical substance to continue to be manufactured or imported into Taiwan. By this date, manufacturers and importers of chemical substances imported to Taiwan, or manufactured, handled, used, or sold domestically between January 1, 1993 and December 31, 2010 were obliged to make a nomination to the Register Office of CLA. Such nominations being a precursor to establishing a National Existing Chemical Substance Inventory.

A period for supplementary nominations in Taiwan has now been announced by the Authorities.

  • The period for submission of supplementary ECN documents has been set from 1 June 2012 to 31 August 2012 for those substances manufactured in or imported into Taiwan between 1 January 1993 and 31 December 2011 and not yet included in the Existing Chemical Substances Inventory.
  • Where manufactures or downstream users do not submit a nomination in the supplementary period, such chemical substances still not included in the Inventory, will be viewed as "new chemical substances" and may need to be registered when imported to Taiwan according to the forthcoming registration process for new substances.

N.B. An offshore manufacture must appoint a Taiwan Agent as a legal representative for their ECN nominations.
