EU - REACH –SVHCs – 6 Substances Added to the Candidate List

An additional six Substances of Very High Concern (SVHCs) have been added to the REACH Candidate List of substances that are to be considered for Authorisation by the European Chemical Agency (ECHA), per the Table.  There are now a total of 144 SVHCs, with the full list available on the ECHA website via this link, http://echa.europa.eu/candidate-list-table.

Use of these 6 substances now incurs several REACH SVHC legal obligations as follows.

Suppliers of articles containing one or more SVHCs have the following obligations under REACH:

  • Provide sufficient information to allow safe use of the article, including as a minimum the name of the substance, to:
    • Customers
    • Consumers, upon request, free of charge and within 45 days of the receipt of the request.
     
  • Notify ECHA, for these 6 new SVHCs the notification deadline is before 20 December 2013 (6 months after inclusion), if the:
    • SVHC is present in articles at a concentration above 0.1 % by weight of the article as supplied, and
    • Total weight of the SVHC in those articles exceeds one tonne per producer or importer per year.
     
  • Notification to ECHA is not required if:
    • Exposure of the SVHC to humans and the environment can be excluded during the use and disposal of the article.  However, the producer or importer shall provide appropriate instructions to the recipient of the article.
    • The SVHC has already been registered for that use.
     

If the SVHC is supplied as a substance customers shall be provided with a safety data sheet.

Where the SVHC is supplied in a mixture that is not classified as dangerous according to Directive 1999/45/EC, customers shall be provided with a safety data sheet on request if certain criteria are met.

SVHCs undergo several stages of scrutiny under REACH, with a view to their addition to the Annex XIV Authorisation List.  Annex XIV specifies the authorised uses, transitional arrangements (application/sunset dates) and, where relevant, exemptions and review periods for SVHCs.

The "sunset date" is the date from which the SVHC can no longer be placed on the market unless:

  • An exemption applies, or
  • An authorisation is granted, or
  • An authorisation application has been submitted before the application date (specified in Annex XIV), but the Commission decision it has not yet been taken.

The final decision on which SVHCs are included in Annex XIV lies with the EU Commission.  The factors taken into account will be authorisation requests from industry, adequate control of the risks posed, and if the socio-economic benefits of an authorised use outweighs the risks, in the absence of alternative substances or technologies.

Please note the Annex XIV Authorisation List requirements only apply to SVHCs supplied as substances or mixtures.  SVHCs in articles are not covered, but may be subject to restrictions by a future amendment to Annex XVII.
