Signed into Law by U.S. President Barack Obama, Effective August 12, 2011

Oak Brook, IL–More than three years after the Consumer Product Safety Improvement Act of 2008 (CPSIA) was introduced, U.S. President Barack Obama signed CPSIA reform bill H.R. 2715 on Friday, August 12, 2011. The bill includes several significant changes to existing requirements for regulated children’s and consumer products, which took effect upon signing. Intertek, a leading provider of quality and safety services to a wide range of industries around the world, has a number of CPSIA services to help consumer products brands, retailers and manufacturers decipher what the new regulations mean to them and help ensure their products are in compliance with the new regulations.

H.R. 2715 includes the following modifications to existing provisions under the CPSIA:

  • Only children’s products manufactured after August 14, 2011, need to comply with the reduced 100 ppm lead substrate limits
  • Inclusion of a functional purpose exemption for lead in certain children’s products and components
  • Total or partial exemptions for lead in certain classes of children’s products
  • Ability for the Consumer Product Safety Commission (CPSC) to grant limited relief from third-party testing
  • Changes to how the CPSC adopts certain voluntary standards as mandatory standards
  • Exclusion of inaccessible parts from phthalates limits
  • Ability for the CPSC to grant exclusions from the tracking label mandate for certain products
  • Changes to CPSC Public Database mechanics
