CPSIA Testing & Certification Rule Training
In November 2011, the U.S. Consumer Product Safety Commission (CPSC) voted to adopt new Testing and Certification and Component Part Testing Rules that govern children’s products. As a result, U.S. domestic manufacturers and importers of children’s products will soon be required to document and maintain a complete technical file in order to certify that their products meet all mandatory CPSC safety standards.
Domestic manufacturers and importers who fail to maintain a technical file may be subject to possible civil fines. Information required in the technical file is extensive and includes a “Periodic/Production Testing Plan” that imparts a “high degree of assurance” of continued standards compliance, as well as formal policies and training to prevent the exercise of “undue influence” over laboratories. In addition, the new Component Part Testing Rule, now in effect, allows companies to issue compliance certificates based in whole or in part on the third-party test reports or certificates provided by component part/materials suppliers, but only under specified conditions and with required documentation.
