Washable tattoos are an appealing product for children due to their fun design. Since they are primarily designed for amusement, these products are categorised as toys. As washable tattoos come into contact with skin, they also partly meet the definition of a cosmetic. Products that cannot be classified in only one category, e.g. toys and cosmetics, are referred to as ‘borderline products’. As such, washable tattoos should be analysed from both a toy and a cosmetic perspective. You need to bear in mind the complete safety of the product being marketed in every respect.
